Board of Appeals
The primary role of a Board of Appeals is to review and decide cases in a zoning decision or where a relaxation of the ordinance is sought. Meetings are held the fourth (4th) Wednesday of the month at 6:00 p.m. at the Salem Lakes Village Hall.
Ordinance 260-15(A) Board of Appeals. The Village Board of the Village of Salem Lakes:
(1) Shall hear and decide appeals where it is alleged that there is error in any order, decision or determination made by the Village Administrator in administering this article, except for cease and desist orders obtained under § 260-14(D);
(2) May authorize, upon appeal, variances from the provisions of this article which are not contrary to the public interest and, where owing to special conditions, a literal enforcement of the provisions of this article will result in unnecessary hardship; and
(3) Shall use the rules, procedures, duties and powers authorized by statute in hearing and deciding appeals and authorizing variances.
(B) Who may appeal. Appeals to the Village Board may be taken by any aggrieved person or by any office, department, board or bureau of the Village of Salem Lakes affected by any decision of the Village Administrator.
When so designated by the Village of Salem Lakes Zoning Board of Appeals, the Planning and Development Administrator shall serve as the office of the Village of Salem Lakes Zoning Board of Appeals for the purpose of filing any papers required by statute and requested by the Zoning Board of Appeals, and for the purpose of keeping minutes of the Zoning Board of Appeals and preparing any papers required by the Zoning Board of Appeals.
Filing Deadline: 30 days prior
